South Carolina does not require a bill of sale for gun sales. Private sellers use it only as legal surety.
People buying a gun from a licensed dealer will still need to fill out a Form 4473, however. That’s because it’s required for those sales by federal law.
If you’re a private seller trying to sell a gun in South Carolina as safely as possible, you can make a bill of sale. Our free template below should help.
The Required Forms for Gun Sales

1. Form 4473
Form 4473 is required by federal law for gun sales made by licensed dealers (also called FFLs). It also starts the background check process on dealers’ gun buyers.
You can usually get the form from your dealer during the transaction. If you want to see it ahead of time, you can find it here too.
2. South Carolina Firearm Bill of Sale
Again, the bill of sale isn’t legally necessary for South Carolina firearm sales. It’s just used when you want to have legal proof of the transaction. This is in case a dispute ever turns up over ownership or liability.
If you’re not sure what to put in a bill of sale, you can use our free template below. You may also want to keep it with photo proof of your buyer’s ID. Just click on the download link below to get the template.
