San Diego Gun Laws and Rules
If you sell to an FFL like Cash for Arms, you generally don’t need to think about these. FFLs will handle legalities for you when you sell guns to them.
Selling to private parties is where you need to put in work to ensure legalities yourself. Our pointers here tell you what you need for that. However, you can also consult these for details:

Age
You can’t sell handguns to anyone under 21 or long guns to anyone under 18 in San Diego (California PC 27510).
ID
You can only sell guns in San Diego to private parties able to present a valid state-issued ID like a California driver’s license (CCR Tit. 11, 4045).
Residency
You can only sell guns in San Diego to private buyers who can prove they’re residents of California. Documents like rental leases, deeds of property, and recent utility bills work (CCR Tit. 11, 4045.1).
PPT
You can only sell guns to private parties in San Diego if an FFL or licensed dealer processes it for you (PC 26500). To get this (a private party transfer or PPT), you’ll have to pay an FFL a $10 fee per transfer.
Background Check
You can only sell guns in San Diego to private parties who can pass a state background check (PC 27545). You can get a check by having your buyer submit a DROS to the FFL processing your sale.
DROS
To start the background check on your buyer, have him submit this to the FFL (CCR Tit. 11, 4200).
This document is also known as the Dealer Record of Sale and is required for California gun sales. You or your buyer also need to pay the FFL for it ($37.19).
FSC
You can only sell guns to private parties with the FSC or Firearm Safety Certificate. There are a few exceptions, which you can find in PC 31700.
The FSC test costs $25 and your buyer only needs to get 75% of the 30 questions correct. Offer this study guide to help him pass it, if needed.
Waiting Period
Gun sales in San Diego need to observe a waiting period of 240 hours (PC 26815).
Buyer Disqualifications
You can’t sell guns to anyone on the buyer disqualification lists. Here are the lists to follow:
Seller Disqualifications
PC 26500, which we cited earlier, also prohibits some people from selling guns in San Diego. These are:
- People with at least 2 misdemeanor convictions of brandishing weapons
- People under 18 years old
- Addicts to narcotics
- Convicted felons
- The mentally ill
Prohibited Guns
You can’t sell .50 BMG rifles and assault weapons in San Diego (PC 30605). It’s not allowed to sell suppressors either (PC 33410).
