Selling a Gun in Tennessee: What the Law Says
For private sales, Tennessee's background-check rule is the same for handguns and long guns. A resident who sells a gun now and then doesn't need a background check. The state check system is for licensed dealers when they sell to a buyer. There's no waiting period, no permit to buy or sell, and no gun registration. State law forbids any government gun registry, and cities and counties can't add their own sale rules, because the state controls gun regulation.
There are still rules. It's a crime to sell any gun to a minor (anyone under 18), to sell to someone you know is barred by state or federal law from having a gun, or to sell to someone who is intoxicated. Federal law adds that you can never sell to anyone you know or have reason to believe can't legally own a gun, and a private sale to someone who lives in another state has to go through a licensed dealer.
Selling to us is a sale to a federally licensed dealer. We document it on our end, and you never have to size up a stranger. Tennessee doesn't add a background check, permit or report for a resident who sells to a licensed dealer.
