New Mexico Rules
What New Mexico Law Means for an Albuquerque Gun Sale
Albuquerque and Bernalillo County can't write their own gun-sale rules. The New Mexico Constitution bars cities and counties from regulating the right to keep and bear arms "in any way," so a sale here follows state and federal law, and New Mexico's rules are stricter than most.
Background checks: most private sales of a handgun, rifle or shotgun need a federal instant background check. If you don't hold a federal firearms license, you arrange for a licensed dealer to run it, for a fee of up to $35. Trades count too, because the law covers a sale for anything of value. Sales between immediate family members (spouse, parent, child, sibling, grandparent, grandchild, great-grandchild, aunt, uncle, niece, nephew or first cousin), sales to law enforcement and sales to or by a licensed dealer are exempt. Skipping a required check is a misdemeanor, each gun counts as a separate offense, and the buyer can be charged as well as the seller.
The seven-day wait: most sales also carry a waiting period of seven calendar days, which includes the time the background check takes, and the gun stays with the seller or the dealer until it ends. Buyers with a federal firearms license or a New Mexico concealed handgun license, law enforcement and immediate family are exempt. In August 2026 a federal court barred enforcement against the two people who sued, and only them. The Department of Public Safety says the wait still applies to every other buyer.
On top of New Mexico's rules, federal law forbids selling to a person you know or have reason to believe is prohibited from owning a gun, and it routes any sale to an out-of-state resident through a licensed dealer.
