Where to Sell Guns in Fremont

Cash for Arms
Cash for Arms is an FFL or licensed dealer that buys guns from every state. As California’s premier gun-buying service, we offer safe and legal sales with zero fuss.
Selling to us only takes three steps and comes with some of the best-rated service on Google. Our offers are also among the highest in the state.
- Tell us about your gun.
- Accept our offer and shipping arrangements.
- Get paid the same day we confirm your gun.
Local FFLs
Any legitimate Fremont gun store is an FFL, as are a few local pawn shops. Selling to them offers legal safety as well, although it will typically pay very little.
Try local stores like Black Dog on Grimmer Boulevard and UG Imports at State Street, but don’t be afraid to go to nearby towns. Santa Clara and San Jose are only half an hour away.
- Call local shops to see who’s interested.
- Bring the unloaded gun to every interested shop.
- Let them appraise the gun and note their offers.
- Compare the offers to find the best one.
- Go back to the shop with the best offer and sell the gun.
Private Parties
You can sell guns to non-FFLs in California if they’re not prohibited persons. These are found in the Gun Control Act and California Penal Code, as we’ll show later.
Private parties are often more flexible than local shops about their sales terms. The downside is that they take a lot of work to find and sell to in this state.
- Ask your buyer to meet you at a local FFL that offers private party transfers.
- At the FFL, have your buyer do these things to start the background check:
- Fill out a DROS (Dealer Record of Sale) form.
- Present valid ID and proof of residency in California.
- Present his FSC (Firearm Safety Certificate) to the FFL.
- Pay the FFL for the background check fee ($37.19 in total).
- Give the gun to the FFL to hold in safekeeping during the sale process.
- If your buyer passes the check, have the FFL process the transfer.
- Pay or have your buyer pay the FFL for the gun transfer.
- Collect your payment for the gun from the buyer.
- Tell your buyer to collect the gun from the FFL 240 hours or 10 days later.

Fremont, California Gun Laws

Fremont follows the federal, state, and municipal gun laws. Consult this list of references for our notes if you want to investigate them more deeply.
- Fremont Firearms Dealer Permit Ordinance
- California Penal Code Part 6
- ATF list of California firearm laws
- California concealed-carry laws
- Federal Gun Control Act (GCA)
- National Firearms Act (NFA)
Age
Your buyer should be at least 21 if he’s buying a handgun at at least 18 if he’s buying rifles or shotguns.
ID
Fremont gun buyers should be able to provide valid, state-issued ID that shows their date of birth, photo, and California address.
Proof of Residency
California accepts several possible documents to prove local residency:
- Utility bills from the past 3 months with the gun buyer’s name and address
- Residential leases with their name and address
- Property deeds with their name and address
- CCW Permits
For more examples, see this page.
FFL Transfer
Virtually all gun sales in California need to go through an FFL or federally licensed gun dealer. See Penal Code 27545.
DROS
The DROS or Dealer Record of Sale is a requirement for all California gun sales. Any gun buyer can fill out and submit it at an FFL.
Background Check
Background checks are required for gun buyers in California. The check starts as soon as the licensed gun dealer submits the buyer’s filled-out DROS to the state.
Firearm Safety Certificate
All gun buyers in California need to present a Firearm Safety Certificate unless exempted by Penal Code 31700. An example of an exempted buyer is an active law enforcement agent.
Waiting Periods
California Penal Code 26815 mandates a gun sale waiting period of 10 days or 240 hours after DROS approval and subsequent receipt of the DROS number.
This means gun buyers can only collect their gun 240 hours after getting approval to buy it.
Buyer Prohibitions
The laws forbid you from selling guns to certain people, like convicted felons, mentally disordered sex offenders, and illegal aliens.
See both the list of prohibited persons for California’s laws as well as the one from the federal Gun Control Act.
Gun Locks
California Penal Code 23620 requires sold guns to come with gun safety devices in Fremont. There are exceptions, such as sales of antique firearms and to people who already have a qualifying gun safe. You can check safety device qualification here.
