Required Age
Your private buyer has to meet these minimum ages, as per PC 27510:
- 18 if buying long guns.
- 21 if buying handguns.
Proof of Identity
Your private buyer has to prove his identity with a valid state-issued ID such as a California driver’s license, as per CCR Tit. 11, 4045.
Document of Residency
Your private buyer has to prove he’s a California resident, as per CCR Tit. 11, 4045.1. Accepted documents include a deed of property and a recent utility bill no older than 90 days.
Private Party Transfer
Because of PC 26500, only licensed gun dealers can legally sell guns in California. So how can a non-dealer like you sell a gun privately? Through the private party transfer (PPT).
A licensed gun dealer or FFL in the state can process a PPT for you and your buyer. It’s how your private sale becomes legal. It generally costs $10 per transfer.
Background Check
Your private buyer needs to pass a background check from the state, as per PC 27545. He can get this started through an FFL as well during the PPT process.
DROS
DROS is the Dealer Record of Sale, and it’s how FFLs initiate background checks, as per CCR Tit. 11, 4200. This means your buyer has to fill out a DROS with the FFL handling your transfer. It will cost $37.19.
Firearm Safety Certificate
This certificate, also called the FSC, is required of nearly every gun buyer in Modesto. The only exceptions are named in PC 31700.
Waiting Period
Your private buyer also needs to follow a waiting period after the sale, as per PC 26815. In Modesto, the waiting period for gun sales is 240 hours.
